1. Introduction
HomeDash Limited ("HomeDash", "we" or "us") is licensed under the Estate Agents Authority (EAA). At present, we provide a platform for private dealings between owners, buyers, tenants, and licensed agents and prospective vendors, purchasers, landlords and tenants. We do not act as an agent in any property transactions, nor do we provide legal, financial or valuation advice. By using the Services, you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and our Personal Information Collection Statement (PICS).
2. Accounts & Eligibility
You must provide accurate account information. You are responsible for keeping your account secure and all activities under your account. We may suspend or terminate accounts for breach of these Terms.
3. Services & Roles
HomeDash provides tools on its platform via website and mobile application ("Services") for:-
- Owners to list properties for sale or rent;
- Buyers/tenants to search, enquire, and schedule viewings;
- Verified agents or agencies to publish property listings; and
- Secured communication and e-signature of e-Viewing Sheets and EAA Forms
4. Listings & Verification
You must post accurate, current information and have authority to list. We may de-duplicate, verify via KYC/Land Registry, watermark, compress, remove or otherwise process content that breaches law or policy. Any pricing indicators are informational only.
5. Contact Reveal & Masked Chat
Chats are masked (i.e. all personal identifiable data are hidden) by default. When you request a contact reveal or schedule a viewing, you consent to HomeDash sharing your name and chosen contact details with the relevant licensed agent/agency for the purpose of responding, arranging viewings, and preparing EAA forms. Agents and agencies are contractually bound to treat such data in accordance with PDPO and our Privacy Policy. Agents may accept/or decline a request for contact reveal. Contact reveals may be quoted metered or pay-per-use. We log basic metadata to prevent spam/fraud and to compute unlock/booking rates.
6. Viewings, e-Viewing Sheets & EAA Forms 1–6
When a viewing is booked, both sides receive confirmations and may be asked to sign an e-Viewing Sheet (immutable PDF). Where applicable, EAA statutory forms (Forms 1–6) can be prepared and executed electronically without altering prescribed text, consistent with the Electronic Transactions Ordinance. Repeated no-shows may affect reputation and access.
7. Fees & Billing
- Certain services such as Contact Reveal and Scheduled Viewing require payment of per-use fees at rates as published from time to time
- Subscriptions & quotas: seat/usage quotas may apply; plan names, features and base prices may change with 30 days notice and are shown in-product at checkout/billing.
- Unless otherwise stated, fees are non-refundable. You authorise our payment processor(s) to charge your selected method, including taxes.
- Transaction deposits/escrow are not handled by HomeDash at this time.
8. Ratings & Reputation
We may publish aggregated ratings and trust signals (e.g., response time, no-show rate). Manipulation may lead to moderation.
9. Acceptable Use
No spam, scraping, reverse-engineering, misleading information, harassment, discrimination, or unlawful activity. Do not upload others' personal data without consent or legal basis. HomeDash may, in its discretion, remove, rank, demote, promote, list, unlist, suspend, timeout, or ban users or content, and request explanation for violations. You may appeal moderation decisions (e.g. ratings, listing rejections, chat bans, etc) through processes we publish from time to time.
10. Third-Party Services
Links to messaging providers, analytics, identity/KYC services and payment processors are not controlled by HomeDash; we are not responsible for their contents. Their terms and privacy policies govern those services.
11. Disclaimers & Liability
The Services are provided "as is" without any explicit or implied warranty. Listings are for reference only and are not warranted by HomeDash. To the maximum extent permitted by law, HomeDash's liability to any user is capped at the greater of (1) total fees paid by that user in the preceding 12 months (or, for new users, average monthly fees x 12), or (2) HK$1,000. However, we do not exclude liability for fraud, wilful misconduct, or non-excludable statutory rights on the part of HomeDash. Property information is provided by agents or owners and is for reference only. HomeDash does not guarantee accuracy or completeness. HomeDash further disclaims responsibilities for conduct of users during viewings or off-platform interactions.
12. Suspension/Termination
We may suspend or terminate accounts that breach policy, harm users, or pose compliance risks. You may cancel at any time (effective at the end of the current term).
13. AI & Beta Features
Some features (including AI-generated content) may be labelled Beta. Outputs may be inaccurate or incomplete; do not rely on them as professional advice. You remain responsible for independent verification and decisions made using such outputs.
14. Availability & Maintenance
We may perform scheduled maintenance and emergency fixes. Service availability/SLA is not guaranteed unless provided in a separate signed schedule. We may modify or discontinue features with notice.
15. Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (including acts of God, power/network failures, epidemics, war, labour disputes, or governmental action).
16. IP & Decoration
You retain ownership of content you submit ("User Content") and you grant HomeDash a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, promote and display User Content for the purposes of operating and providing the Services. You warrant you own or have permission to the User Content provided by you and that it does not infringe any third-party rights. We may remove content alleged to infringe rights or violate policy. Report concerns to info@homedash.hk with details; we may notify the submitter and act in our discretion. HomeDash owns all rights to the platform, software and branding. Copyright subsists automatically in our original works. Trademarks (including "HomeDash" and logo) are proprietary and may not be used without permission.
17. Boilerplate
Assignment. You may not assign without our consent; we may assign to an affiliate or in a merger/acquisition. Notices. Notices will be given via Email, in-app notifications or postings on the platform. Users may contact HomeDash at info@homedash.hk. Severability. If a term is unenforceable or invalid, the remainder remains in effect and enforceable. Waiver. Failure to enforce a right is not a waiver. Entire agreement; order of precedence. These Terms are the entire agreement between you and HomeDash regarding the Services.
18. Governing Law & Disputes
These Terms are governed by the laws of Hong Kong SAR and courts of Hong Kong SAR have exclusive jurisdiction.
